PROSTITUTION
AND THE UNIVERSAL DECLARATION OF HUMAN RIGHTS
(italiano)
With the Universal Declaration of
Human Rights of United Nations we can read that
this one can ensure the legal existence of prostitution. In fact, if we
consider the relative articles 1, 2, 6,
7, and 20 number 1, we see that this activity can be ensured by those said
text, at least in a way getting it in a minimum of legality, either for
relative paying, or the same selling.
Below are listened the said articles.
All human beings are born free and equal in dignity and rights. They are
endowed with reason and conscience and should act towards one another in a
spirit of brotherhood.
Everyone
is entitled to all the rights and freedoms set forth in this Declaration,
without distinction of any kind, such as race, colour,
sex, language, religion, political or other opinion, national or social origin,
property, birth or other status. Furthermore, no distinction shall be made on
the basis of the political, jurisdictional or international status of the
country or territory to which a person belongs, whether it be independent,
trust, non-self-governing or under any other limitation of sovereignty.
Everyone
has the right to recognition everywhere as a person before the law.
All
are equal before the law and are entitled without any discrimination to equal
protection of the law. All are entitled to equal protection against any
discrimination in violation of this Declaration and against any incitement to
such discrimination.
1)
Everyone has the right to freedom of peaceful assembly and association.
(omissis).
It is possible to realize that at the
above-mentioned article 1,
prostitution about its choice among adult and consentient people can be
protected by the equality of people and by the conscience reason, without
saying in this point that the sex trade cannot be considered as a free choice
among adult people.
About the relative article 2 we can understand that the sex workers and/or
corresponding customers can be politically and socially protected by the same
principle of social equality and by any other condition.
The mentioned article 6 denotes who engages in prostitution can be legally recognized
for his/her work.
The following article 7 notes that the sex workers and/or relative customers
cannot be deviated from the other persons’ rights.
At last, the same article 20 number 1 says that as all people even prostitutes and
corresponding clients have the right to get assembly peacefully.
With all this one it is possible to
declare that prostitution can be clearly protected by The Universal Declaration of
Human Rights of United Nations
and all Member States of this Organization which has ratified this
international law must at least give the sex sellers and relative payers a
minimum to stay in a relative condition of legality.
